Notice to Patients Regarding the Destruction of Health Care Records

Nevada law requires health care records to be retained for at least five years after their receipt or production. Health care records may be destroyed after that period, subject to applicable law.

Health care records may not be destroyed while the person who is the subject of the records is under 23 years of age.

A longer retention period applies whenever one is required by federal or state law, by contract, or by a litigation hold, investigation, audit, or other preservation requirement.

Tristan Cooper MD PLLC, doing business as NextDayDoctor Medical Group, currently applies a general ten-year retention period to clinical records where that period is longer than the minimum required by Nevada law. This is the practice's own standard. It does not shorten any longer period that law, contract, or a preservation obligation requires.
